Operators file suit against Germany’s 5G terms

Deutsche Telekom has become the latest operator to file a lawsuit against the conditions for participating in Germany’s 5G mobile spectrum auction, which is scheduled to take place in the spring, notes TeleGeography. In November last year the Federal Network Agency (Bundesnetzagentur or BNetzA) tightened up the auction rules by imposing more extensive coverage obligations and including measures to promote competition, such as national roaming requirements. According to a report in Die Welt, a Deutsche Telekom spokesperson said: “From the outset, we said that the conditions imposed on the auction are unrealistic and create legal uncertainty. The tightened expansion requirements go well beyond what the BNetzA has previously described as reasonable and proportionate.” Deutsche Telekom states that the new conditions discourage further investment in network infrastructure, particularly in rural areas. Telefonica and Vodafone are also suing the regulator to determine the legality of the new conditions. See TeleGeography report here  and BNetzA announcements (in German) here.
